# Terms of Service & Customer Agreement

## 1. Scope of Services
Home Check Axarquía provides scheduled visual exterior property checks and perimeter key care for residential second homes in Nerja, Torrox, Frigiliana, and Cómpeta (Málaga, Spain). Inspections are visual and non-invasive. The service does not constitute an architectural survey, structural engineering report, or alarm monitoring service.

## 2. Statutory Exclusion under Spanish Private Security Law (Ley 5/2014)
**Important Legal Notice:** Home Check Axarquía is NOT a private security guard company and does not provide armed guarding, continuous surveillance patrols, alarm monitoring, or physical anti-squatter intervention.
Our activities are performed strictly under the statutory exclusions set out in **Article 6.2 of Spanish Ley 5/2014 de Seguridad Privada**:
- *Article 6.2.a:* Custody and care of keys and auxiliary access assistance.
- *Article 6.2.d:* Technical verification of the condition and functioning of property and installations to guarantee conservation.

## 3. Key Care & Privacy
We accept perimeter gate keys only (no interior house keys). Keys are coded anonymously and held in an off-site safe.

## 4. Pricing, Taxes & Payment
- All stated consumer prices include Spanish 21% IVA.
- Payment is accepted via Bank Transfer (SEPA), Bizum, or Card.
- Invoices are issued in accordance with Spanish tax regulations.

## 5. Cancellation & Subscription Policy
- Monthly care plans can be cancelled or paused anytime with 7 days' written notice before the next billing cycle.
- Prepaid packs are valid for 12 months from purchase.

## 6. Civil Liability & Insurance
Home Check Axarquía is covered by an active Spanish Public Liability Insurance policy (*Seguro de Responsabilidad Civil*) covering third-party damage, entrusted property, and key custody.
